Fox Promised Nunes a Fair Hearing for Johnston Casino
House Majority Leader Gordon D. Fox was involved in several behind-the-scenes maneuvers over bringing a casino to Johnston.
Developer David H. Nunes had a conversation with Fox as early as 2003 regarding the Trump Entertainment Resorts plan to build a Casino in Johnston. Nunes said that Fox promised him a "fair hearing" on bringing a casino to Johnston.
"Representative Fox assured me that if I brought a competitive casino proposal to the Legislature, such proposal would receive a fair hearing. Representative Fox also suggested that I explore the Town of Johnston as a possible location." Nunes said in the recent affidavit he wrote.
"I had numerous meetings with Representative Fox over the course of a two year period."
Nunes filed a lawsuit in federal court seeking to block a ballot question against asking voters to amend the state Constitution to give Harrah's Entertainment and the Narragansett Indian tribe a casino in West Warwick.
A hearing is scheduled tomorrow, August 7, by U.S. District Court Judge William E. Smith for lawyers to present their case. The judge told the lawyers that his initial ruling will be on Wednesday, August 9. The ruling is whether to proceed with the ballot question or not.
On the other hand, Fox said through a spokesman, that Fox refuses to comment on his interactions with Nunes.
"It would be inappropriate to comment on an affidavit that has been submitted in pending litigation before the U.S. District Court," Fox said in a statement.
Nunes was asked if he ever get a fair hearing. He said "I can't comment on ongoing legal matters."
